What is cartel conduct?
Cartel conduct involves businesses colluding rather than competing, by engaging in price-fixing, dividing up markets, restricting output or bid rigging.
New Zealand cartel laws apply to all written and verbal agreements, including informal arrangements.
In 2021, cartel conduct in New Zealand was formally criminalised under the Commerce (Criminalisation of Cartels) Amendment Act 2019.
Individuals who intentionally engage in cartel conduct can now face up to seven years in prison and be fined up to $500,000.
Businesses can face fines up to $10 million, or three times the commercial gain, or 10% of the turnover.
